Site policy for the learning platform of the Christian-Albrechts-Universität of Kiel

1 Terms of Use

 

The user of the Learn-Management-System of the Christian-Albrechts-Universität of Kiel takes notice that this platform is used for educational purposes only.

The user is not allowed to violate German law or the rights of a third party(e.g. copyright owners,data privacy).

The user complies that no racism, pornographic content or content depicting explicit violence will be shown or saved using this platform and their servers.

Furthermore, the user will not encourage crimes or publish tutorials using the Learn-Management-System.

 

The Christian-Albrechts-Universität of Kiel may restrict access to the platform and its servers

if the user violates the rules and additional terms of use or misuses the platform.

Sometimes additional measurements may be undertaken by the university such as erasing data or reporting the incidents to the police for further processing.

 

2 Rights and duties of the user

 

(1) The user has the right to use the platform for educational purposes.

 

(2) The user has the right:

-to request information about his personal data which is saved and all other data as stated in §27 LDSG-SH (purpose of the data storage, their legal basis, origin and receivers of this data in case it is transmitted.

-to demand the correction, deletion or restriction of his personal data according to (§28 LDSG-SH)

The user has the right to revoke future usage of this platform. In this case the legal basis for the processing of his personal information is void and his personal data will be deleted or restricted according to §28 paragraph 2,number 2 or §28 paragraph 3 LDSG-SH.

 

(3) It is the users’ duty to:

1. respect the terms of use and to not seek to exploit the rules

2. undertake no actions which might disturb the operations of the platform

3. use only logins for the platform which are allowed and to not misuse them

4. protect the passwords for their logins  from third persons

5. undertake no actions for recovering other users passwords or logins or to use them

6. not access other users data or report them to third persons without proper permission

7. obey the law when it comes to use the documentation, especially the copyright.

8. neither copy nor redistribute information provided by the platform or to use it in any manner other than the allowed one without proper permission

 

(4) We reference the following crimes:

1. espionage of data(§202 a StGB)

2. manipulation of data(§303 a StGB) and computer sabotage (§303 b StGB)

3. computer fraud(§262 a StGB)

4. distribution of pornography(§184 StGB),especially request and possession of child pornography (§184 paragraph 5 StGB)

5. distribution of propaganda  of illegal organizations (§86 StGB) or hate crime(§130 StGB)

6. crimes against honor such as insult or defamation.(§§185 ff StGB)

7. punishable copyright infringements (§§106 ff. UrhG)

 

(5) We reference to the Kommunikationsdiestegesetz and the Mediendienstestaatsvertrag.

 

 

3 Exclusion from usage

 

(1) The user’s access might be restricted or revoked temporarily or permanently if the user violated §2 paragraph 3 and 4 (malicious behavior) on purpose.

(2)Measures according to 3.1 may be enforced after warning the user and in consensus with the Dekan/in& of the administrating faculty.

The user has the right to properly state his case.

In either way, the data of the user is to be stored.

(3)Temporary restrictions which are ordered by the project eLK.Medien according to 3.2 are to be lifted if the reliable operation of the platform is guaranteed.

(4) A permanent restriction or revocation of the user’s rights is only possible if the user violated paragraph 1 or violated the general terms of usage in a very severe way and if no orderly behavior is to be expected.

The decision of permanently restricting or revoke the rights of a user is made by the management of the eLK.Medien project.

 

 

4 Data Security

 

4.1 Personal data visible on the platforms’ website

 

The platform is not available to the public by default. However, it is accessible by authorized personal.

 

4.2 Personal data visible to the students

 

Every user of the platform has the attributes username, first name, last name and e-mail address.

The user’s personal profile (visiting card) has to show the username only.

Any other attribute is optional.

Additional personal informations are  optional and can be changed or removed (partially or completely) at any time by the user.

 

If the user is shown using the user-search or is listed in a group-list, then the attributes username, first name, last name, and e-mail address are shown. However, these attributes may not be shown in the personal profile.

 

 

4.3 Personal data visible to authors

 

Authors can not see the users of their open courses.

The only exception to this rule are courses with prior registration, tests, assignments, study groups and –areas. Within this groups the author is able to view personal data, username, first name, last name, and e-mail address of the participant.

 

4.4 Personal data visible to administrators

 

Administrators are able to view all the personal information of a user (eg. username, first name, last name, e-mail address as well as further personal information), because of the relevance of this actions to conduct their jobs.

 

4.5 Storage of data of access, editing and evaluation

 

4.5.1 Data of access

 

Statistics of accessing resources are stored for purpose of elevation.

 

4.5.2 Data of evaluation for students

 

Students can view some answers of their tests and assignments and eventually the scores made. Results of other users are not visible.

 

4.5.3 Data of evaluation for authors

 

The score and answers of tests such as assignments used for self-evaluation and self-tests can only be viewed anonymously.

The score and answers of other tests can be seen in a personalized way.

 

4.6 Cookies

 

Cookies are alphanumeric identifiers, which are temporarily loaded in the computers RAM (Session Cookies).

Therefore these cookies are erased after the browser is closed.

You can not use the platform with cookies deactivated because the platform checks the actual session using cookies.

 

 

 

5 Liability of the University

 

(1)The university does not guarantee a non faulty behavior of the system.

Therefore interrupts affecting the availability of the system may occur.

The eventual loss of data due to technical problems or the compromise of personal data by a third party can not be foreclosed.

 

(2)The university denies all responsibility regarding the perfection of the provided system.

 

(3)The university is only responsible in cases of intended misuse and acts of negligence of its employees. The liability of the university is typically limited to damages which can be foreseen at the closing of this contract as long as no acts of negligence were committed.

Damages affecting people are governed by the law.

6 Rights of the user

 

The user has the right:

 

  • to request information about stored data affecting the user as well as further information according to §27 LDSG-SH(purpose and laws regulating the stored data, origin of these information and receivers of these information(in case of a transmit))
  • to request correction, deletion or restriction of this information according to §28 LDSG-SH.

 

The User has the right to terminate any further participation in this platform.

In this case, the laws for processing the users personal information do not apply any more and the information is deleted or restricted according to §28 paragraph 2, number 2 or §28 paragraph3 LDSG-SG respectively.
